Description :

The State Historical Society of North Dakota (the STATE) is soliciting proposals for Native American
Graves Protection and Repatriation Act (NAGPRA) consultation and planning services. The consultant
will assist in the development of a comprehensive plan for the audit, review, and enhancement of
policies and procedures pertaining to NAGPRA.
3.2 APPLICABLE DIRECTIVES
This project is subject to the following Native American Graves Protection and Repatriation Act
Regulations including:
• RIN 1024-AC07, 1993 Proposed Rule (58 FR 31122, May 28, 1993) and 1995 Final Rule (60
FR 62134, December 4, 1995);
• RIN 1024-AC84, Civil Penalties Final Rule (68 FR 16354, April 3, 2003) and Future Applicability
Final Rule (72 FR 13184, March 21, 2007);
• RIN 1024-AD68, 2007 Proposed Rule Disposition of Culturally Unidentifiable Human Remains
(72 FR 58582, October 16, 2007) and 2010 Final Rule Disposition of Culturally Unidentifiable
Human Remains (75 FR 12378, March 15, 2010);
• RIN 1024-AE00, Disposition of Unclaimed Cultural Items Final Rule (80 FR 68465, November 5,
2015); and
• RIN 1024-AE19, Native American Graves Protection and Repatriation Act Systematic
Processes for Disposition or Repatriation of Cultural Items Final Rule (88 FR 86452, December
13, 2023).
The contractor is responsible for identifying and complying with all state and federal requirements that
apply to the contract.
3.3 REQUIREMENTS
A. DELIVERABLES
The contractor will be required to provide the following to achieve the objective of this project:
1. Develop a plan to audit current NAGPRA practices across three departments: Archaeology
& Historic Preservation, Audience Engagement & Museum, and Archives.
2. Provide guidance concerning compliance with new NAGPRA standards including expertise
in the law and implementation, cultural sensitivity, and ethical considerations.
3. Recommend updates to SHSND policies and procedures to comply with new NAGPRA
standards.
4. Provide specialized expertise to guide the SHSND through the process of implementation of
updated policies and procedures (from deliverable #3) for conducting reviews and audits,
that align with the requirements of the law.
5. Provide guidance to SHSND on procedures to facilitate respectful engagement with Native
American tribal nations and communities, ensuring that SHSND repatriation efforts are
conducted in a manner that honors their cultural heritage and traditions.
6. Document all findings, observations, and recommendations in a comprehensive report. The
comprehensive report should include detailed audit processes and policy and procedure
review, including any supporting evidence or data collected during the assessment and
outline/recommend a path forward for SHSND to improve NAGPRA compliance efforts and
foster positive relationships with tribal communicates.
7. Present the findings and recommendations to the SHSND leadership and other relevant

stakeholders through formal presentations or meetings as requested.
8. Offer a minimum of three recorded training sessions or workshops in person and/or via
Microsoft Teams to SHSND staff members involved in collections management,
emphasizing NAGPRA compliance requirements and best practices. Provide guidance and
resources to support ongoing efforts to enhance NAGPRA compliance within SHSND.
Trainings shall consist of one training related to each of the following:
• Museum collection items
• Archaeolo
