The applications main purpose is to track milestones associated with administrative and civil enforcement documents to ensure compliance. Features of this application will provide DEQ staff with helpful reminders to track compliance rates by division, region, program, or statewide. A hyperlink to the mock-up screens developed for this project, along with examples of enforcement orders, have been included with this PSO to assist responding contractors in developing a proposal for a comprehensive solution for this project. DEQ Organization. DEQ is organized with a state office and six regional offices. There are multiple programs within three primary divisions to be included in the application: Air Division: mobile & area source, smoke management, and Title V; Waste Division: hazardous waste, solid waste, mine waste, and UST/LUST; Water Division: wastewater/reuse, drinking water, ground water, TMDL, and IPDES. The Boise Regional Office also administers a program for vehicle inspection and maintenance (I&M), which will be included. The DEQ regional office staff oversees implementation in their respective counties for all of the programs referenced above. The state office program staff develops enforcement orders in collaboration with regional staff, attorneys, and management. The regional offices track implementation of the enforcement orders. Enforcement Documents. Enforceable orders, which are generically called cases, are entered into or are imposed by the administrative or court process in response to violations. The milestones or schedules DEQ will track are associated to the following enforceable documents: Consent Orders (COs), Compliance Agreement Schedules (CASs), Compliance Schedule Orders (CSOs) and Civil Orders or Judgments (Civil). An enforcement document is issued to an entity (or multiple entities) such as a business, organization, system, individual, association, and/or district. An enforcement document may also include one or more program areas such as drinking water and wastewater. All enforcement documents may be amended or superseded (e.g. A-CO, S-CO) and will eventually be terminated (TERM). Excluded from the tracking system are milestones associated with Notices of Violation and permits. Cases. The case table will be the central table for the database. The “case name” is the entity (or entities) the enforceable document is issued to, as identified in the enforcement document following “In the matter of.” Using the case name is consistent with the naming convention in the Enforcement Action Search Tool (EAST) where the final enforcement documents are stored in .pdf file format. Each case will need an additional optional field for a unique case number (currently used by the DEQ Air Program). Entity. DEQ will use the generic term “entity” to identify the legal name for the subject of the enforcement case, which can often be located through the Idaho Secretary of States business records or the Idaho State Tax Commission for Water/Sewer Districts. Each entity will need an additional optional field for an “alias” when an entity is renamed or is alternatively known as something different. The case name and the entity name may be the same. Facility. The facility name generally indicates the location/site of the violation. The facility name may be the same name as the entity. Each facility will need an additional optional field for a second name when a facility is renamed or is alternatively known as something different.
