The STATE is soliciting proposals for a centralized criminal background check system.

This information technology project is subject to the following:
• N.D.C.C. § 54-10-28 related to the state auditors authority to conduct information technology compliance reviews.
• N.D.C.C. §§ 54-35-15.2, 54-35-15.3, and 54-35-15.4 related reporting to and review by the Legislative Council Information Technology Committee.
• N.D.C.C.§ 54-59 related to the Information Technology Department

The work performed under this Contract must comply with the requirements of the following:

• 45 CFR Part 95. 621(f) related to ADP System Security Requirement and Review Process
• 45 CFR §§155.260 and 155.280; applies to all ACA Administering Entities (AE)
• 5 U.S.C.552a (o)(1)(F),(H), and (I) Records Usage, Duplication, Retention, Re-disclosure, and Timely Destruction Procedures/Restrictions
• Federal Information Processing Standards (FIPS) 140-2 issued by the NIST
• NIST 800-53 Accessing Security and Privacy Controls in Federal Information Systems and Organizations
• NIST Special Publications 800-111 Storage Encryption Technology for End-User Devices
• CMS Minimum ARS for Exchanges (MARS-E) 2.2 guidance on the protection of security and privacy in the ACA program environment
• CFR Title 45 (Parts 1-199)/Code of Federal Regulations Title 45 Public Welfare Revised (Specifically 164 Security and Privacy)
• FIPS PUB 112 Password Usage Procedure
• FIPS PUB 186-3 Digital Signature Standard
• 44 U.S.C. 3303a Federal Records Retention Schedule
• 5 U.S.C. 552a Privacy Act of 1974
• 45 CFR Part 160 and Part 164, Subparts A and C, Health Insurance Portability and Accountability Act of 1996 (HIPAA, Title II)
• Section 13410(d) of the HITECH Act
• 42 CFR Part 457 U.S. Code Subchapter XXI - STATE CHIP
• 42 CFR §433.112, which includes the Medicaid Information Technology Architecture (“MITA”)
• 441.199 Medicaid (Title XIX) Confidentiality Rules
• Child Online Privacy Protection Act
• HIPAA - Administrative Simplification, including transactions and code sets, privacy, and security provisions
• Computer Matching and Privacy Protection Act of 1998 (CMPPA)
• Federal Information Security Management (FISMA)
• SSA Information System Security Guidelines for Federal, State, and Local Agencies

REQUIREMENTS

The STATE has developed Requirements Matrix – Attachment A – to describe the requirements for the proposed solution. See this attachment for a detailed description of the required and desired features and functionality of the IT solution. The IT solution must be implemented with a minimum of all requirements rated with a priority of Core and Essential.

The Information Technology Solution contains three (3) tabs within the Requirements Matrix.

• General Requirements
• Enterprise Architect Specs
• Functional Requirements

If the Offeror is successful, the Offeror agrees that it shall comply with all requirements throughout the full term of the Contract. Offerors must provide a full response to each requirement without cross referencing other sections of the proposal. Offerors must use the table format and maintain numbering provided by the STATE to respond to each requirement. Attachments, documents, or samples must be clearly referenced where in the response they can be found in the in the applicable item number.
In addition, the Offeror Response must include any specific references and/or supportive materials as described in the Offeror Response.
