Description :

The STATE is soliciting proposals for a vendor to assist STATE with crafting and recommending a
supportive regulatory setting for captive insurers in North Dakota and promoting North Dakota as a
preferred base for captive insurance entities. The work involved in this solicitation shall include, but not
be limited to, creating comprehensive analysis that examines the current state of the captive insurance
market and regulatory proposals and a strategic engagement plan to creative an attractive environment
for captive insurance entities. At all times the vendor shall work closely with STATEs staff and other
vendors, including STATEs contracted program manager, JW Hammer LLC. To be considered for this
contract award, it is highly recommended that the Offeror meets the experience requirements. While
meeting these requirements is not mandatory, proposals from Offerors with background experience in a
majority of the areas listed by Purchasing Agency will be given preferential consideration.
3.2 REQUIREMENTS
A. DELIVERABLES
The contractor will be required to provide the following to achieve the objective(s) of this project:
1. Strategic Engagement Plan: This Plan should lay the groundwork for North Dakota to
emerge as a leader in the captive insurance industry. This is not merely about
introducing a new business concept; its about seizing a strategic opportunity to enhance
our states value proposition to businesses nationwide.
2. Comprehensive Study on Legal, Regulatory, and Policy Challenges and
Opportunities: A comprehensive analysis that examines the current state of the captive
insurance market, with a particular focus on identifying gaps and opportunities where
North Dakota can carve out a niche for itself. This analysis will serve as a cornerstone
for understanding how the state can differentiate itself from other regions and which
legislative, regulatory or policy proposals need drafted.
3. Legislative, Regulatory, and Policy Proposals for Captive Insurance Entities: A set
of legal, policy and/or regulatory proposals designed to create a fertile environment for
captive insurance entities. These proposals will outline the steps North Dakota can take
to attract and retain captive insurance companies, including marketing strategies,
incentives, and support services. All draft legislation shall be written by CONTRACTOR
in accordance with the most recent version of the North Dakota Legislative Councils
Legislative Drafting Manual.
B. PROJECT MANAGEMENT PLAN
The contractor will be expected to use appropriate project management to ensure the work is
accomplished on time, within budget, and meets quantity and quality standards. At the direction
of STATEs contracted program manager, JW Hammer LLC, contractor will be required to
1. Collaborate with the STATE to agree upon the contract schedule, including a work
breakdown, schedule of tasks and activities, and progress milestones.
2. Coordinate with the STATE to develop a communication plan. Any problems or
unforeseen events must be communicated timely to the STATE project manager and
any changes must be agreed upon between the parties and set forth in a written
